PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING OUR COACHING SERVICES. By using our coaching services, you signify your consent to these terms of services. If you do not agree to these Terms of Services, please do not use our services.

This Agreement is made and entered into by and between Business Owner Mastery LLC, a New York corporation with an address at 228 Park Ave S #620282, New York, NY 10003 (“Business Owner Mastery”) and you (“Client”), (individually a “Party” and collectively the “Parties”).

Whereas, Client owns a business and desires to engage Business Owner Mastery as an independent contractor for coaching services (the “Services”); and

Whereas, Business Owner Mastery is willing to accept such engagement and perform such Services, in accordance with the terms of this Agreement and upon Client making their payment prior to the service delivery.

Now, Therefore, for good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties agree as follows.

Services

Coach and Client agree to engage in (1) private 1:1 coaching session (up to 60 minutes via phone or online).

This session must be conducted within one month of payment.

If Client wishes to extend the coaching relationship, both Coach and Client must agree in writing (including by e-mail) to any additional services and payment terms.

The terms of this Agreement will continue to apply unless superseded by another agreement in writing.

The Coaching Relationship

The coaching relationship is co-creative, meaning that the Coach and Client are equal partners in the coaching process.

Coaching is designed to help you change the way you think, which will affect your feelings, which will affect your actions, which will ultimately affect your
results.

Coaching is an alliance between the Coach and the Client.

Coach cannot, and does not, guarantee particular results.

Coach does not provide any financial, legal, medical, or psychological service or advice.

Coaching does not prevent, cure, or treat any mental or medical condition.

Coaching is not intended to be a substitute for professional advice that can be provided by your own accountant, lawyer, financial advisor, or medical professional.

You are responsible for your own financial, legal, physical, mental, and emotional well-being, decisions, choices, actions, and results.

Coach and any company that Coach is affiliated with, disclaims any liability for your reliance on any opinions or advice received as part of the coaching relationship.

You agree that you will not use coaching as a way of diagnosing or treating mental disorders as defined by the American Psychiatric Association.

If you are in therapy or under the care of a mental health professional, you will notify and consult with the mental health care provider regarding your decision whether to work with a coach.

Coaching Materials

Client acknowledges that Coach owns, or has permission to use, all copyrights, trademarks, and other intellectual property rights in any written or online materials, workshops, or videos that may be used during our coaching relationship.

Coach hereby grants Client permission to use these materials for Client’s own personal use only.

Client agrees not to copy, share, sell, or distribute any of these materials to anyone else.

Confidentiality

Coach agrees to keep all information about the Coach / Client relationship strictly confidential except in very rare circumstances where disclosure is required by law. For example, when a court might issue a subpoena for the file or information, or if the Client threatens to harm himself or herself, or others.

Client acknowledges that Coach / Client communications are not covered by any doctor-patient privilege or other privilege.

If Client wishes for Coach to speak to a third-party relating to the coaching relationship, then Client needs to give Coach written permission (original signed letter or e-mail) to do so.

This confidentiality provision shall survive the termination of this Agreement.

Session Procedure

Session will last up to 60 minutes and will take place by phone or online.

We will meet via our designated Zoom link that Coach will provide in advance.

You agree to show up for your scheduled private coaching session on time.

Your coach will wait 10 minutes from your scheduled time.

  • If you do show up within those 10 minutes, the session will still end according to the original end time.
  • If you do not show up within those 10 minutes, this will result in the forfeit of the coaching session that was reserved for you.

 

A 24-hour cancellation notice is required for all scheduled sessions.

Cancellation requests made less than 24-hours prior to your scheduled session will result in the forfeit of the coaching session that was reserved for you.

If Coach or Client must reschedule the session last minute due to an emergency, the missed session will be rescheduled.

Fees and Payment Schedule

Client agrees to the following fees and payment schedule:

  • (1) session is $150.00 USD.
  • Payable in full prior to the session.

Termination and Refunds

The fee for your session is non-refundable unless mutually agreed upon in writing.

Limitation of Liability, Release

Client agrees that Coach will not be liable to Client or any third party for any damages (including, but not limited to, lost data, lost profits, incidental or consequential damages), that arise from coaching.
